Commercial Courses at TAFE

This section covers common Copyright questions for where the course is run on a commercial/fee for service basis.

Can I rely on s113P to copy or communicate class materials, if profit margin/admin fees are placed on the course materials, when delivering a commercial course?

No.

  • A TAFE  College is not permitted to rely on s113P in this situation.
  • s113P can only be relied on where course materials that include the s113P material are free or sold at cost (i.e. the sale price only covers the physical production of the materials and does not include a profit margin).
